Digital Law


The goal of this page is to teach people about digital law giving real life examples not only to explain it, but to show the impacts it has on our everyday life. People of all ages need to understand the importance of Digital Law. It is important for people to know, because like I mentioned, it is in our everyday life, even more as we grow up and time passes by.

1. Overview and Description

Digital law: This is the electronic responsibility for actions which says if something is ethical or unethical. The responsibility of the digital law deals with the ethics of technology as a whole. Digital Law deals with four main topics: copyright, privacy, ethical issues, and piracy. Unethical use of computers can form into theft or crime like piracy. People that are ethical in the use of their computers may actually be the ones being hurt by those who are not following these protective laws. A student should not be allowed to mess with other peoples work or identity with rules being applied. We have the digital Law to basically protect us; since most people don't follow it, the internet is becoming a very dangerous place.

There are many situations that deal with Digital Law. There are so many new illegal ways to get what you want and not get caught that it is very hard to find the causes of viruses and other crimes. Some problems with Elementary students are that they can get on sites too mature for their age. The information on these sites may be inappropriate for their age group. Another problem may be that older people may harass them. There are also some problems with Middle/High school aged students. They may get on sites such as MySpace or Facebook and lie about their age, name, or any other aspects of their lives. This is not a very smart act considering that later they may be abused. They may use bad language on the internet or chat rooms. Predators can trick some teens that are unaware of such dangers into meeting up with them. Parents/guardians are unaware of what teens are looking at and/or doing and therefore cannot stop them from seeing and/or doing inappropriate things. Some teens download illegal music such as Limewire or Bearshare.This affects not only the artist, but record producing companies. In this day and time, many teens have their own computers and can look at things and their parents remain unaware of their actions. There are also some problems with adults. Using bad language, harassing and trapping youth, and the buying and selling of illegal merchandise are just some of the problems the adult generation faces today. Many adults are very sneaky and can use tricks to socialize with young adolescents. Some adults use Facebook, Myspace, or chatrooms to trick younger people into meeting up with them. These are just some of the main problems our generation of all different ages faces in this day and time.

Elementary Aged Students

Computer and technology is becoming available for people of all ages, and now for elementary students. I think it is good for elementary students to use computers, but they must know about Digital Law. They have to understand what kind of sites to access and which ones not to. There are some websites that are safe and made for them and I think they should stay on those. I don't think they will buy or sell the wrong things, but they need to understand that selling stuff until they know how to is bad.

Middle/ High School Aged Students

The big problem with middle school students is piracy--not world piracy but electronic piracy along with privacy.
Kinds of illegal software use that can be qualified as copyright violation:
- selling of computer facilities with illegally installed software;
- replication and distribution of software copies on information carriers without permission of the copyright owner;
- illegal distribution of software through communication networks (Internet, e-mail, etc.);
- illegal use of software by the user.
LimeWire is an illegal music client for the unethical buyer. This place, along with many others like Bearshare, is
illegal, and you will be charged if found.
Not only is electronic piracy found, but violation of minors is also a problem (privacy). The law is there to protect people that are younger than eighteen years old. Yet, the case is that children do not facilitate the law in order for it to protect them. They might lie about their age on public pages which could lead to violation of a minor. How can the law protect the people if the people provoke it? For more details or an exact example, see section two for Middle School Students.

It can be used for hacking and learning information about people and really making people's lives that much harder.

Adults

It is scary how much adults can do with computers if they have the education to do so.
The buying and selling of illegal merchandise is the main problem I think we have. It is very simple to find illegal objects on the internet that you can purchase. Another problem is the pretending to be something they're not, and their main objective is to get your money or steal your identity. That is identity theft and that is breaking the law. Some adults use the internet like myspace and facebook to trick younger people to meeting up by lying to them about their age as well as other things. I think there are too many adults that participate in the breaking of the law, but you just have to be safe and knowledgeable in what to do and not to on the internet.dans data

Another problem is downloading illegal music. There so many people downloading illegal music and sharing the file and/or CD-burning for their friends and/or selling them. This is called music piracy; it is when you download the music without the artist’s permission and doing what you like with it, this is considered steeling. This affects many people, the artist, the band, the performers, and the recording engineers

Another issue is protecting your email address from being shared between different websites because people can send you junk mail, spam and viruses to your computer. Another thing you should watch out for is doing banking or using your credit card on the internet because people will trick you in giving that information away.


2. Background of the topic including specific real examples.



Elementary Aged Students

Myspace and Facebook and many others all help broadcast young and old . The one problem with these certain websites is that young kids can lie and tell other people that their really other people. This sometimes turns out bad and could lead to people going to jail. A lot of bad people considered petifiles post bogus pages to fool young kids online.

Unfortunately, there are many negative effects to allowing your child to explore the internet freely when they don’t yet fully understand the dangers of the Internet. For example, there are people on the internet who do not have good intentions in mind. They may try to take advantage of your child. For, at the young age many elementary aged school children are, they are very trusting and can be cajoled to give out information that may be very personal and should be kept secret. Full names, addresses, phone numbers, even birthdays, all revealed to the wrong person can be very dangerous. Your child could be led into a seemingly innocent “play date” with another “child” his/her age and have that situation turn out scarily wrong. Or, another example: There are many sites made for children of this elementary age. They can be educational or just fun, but they are definitely appropriate. However, URLs for inappropriate sites are often played off of the kid’s sites’ URLs. In this way children may accidentally type the URL wrong and visit the inappropriate sites. With people as desperate as this on the Internet children must be taught correct and safe internet use versus facing these scarring situations.


Middle/ High School Aged Students


There is a very interesting controversy brewing in Orange County, Florida. A 13-year-old girl Alisha Dean has a MySpace page that portrays herself as a 19-year-old divorced woman. She has been accused about lying to two men — Morris Williams, 22, and Darwin Mills, 24, about her age in two separate incidents. Both have been convicted and sent to jail for statutory rape.
Digital Law for Middle School students not only has to deal with privacy but copyright and piracy.

Adults

There are people out there that will trap you in to getting in to trouble and harass you with a computer.

Some adults will trick you into thinking they are someone else of a different age. Adults sometimes will sell or buy illegal products knowingly. Some of the main programs that are used to trick the younger generation are Myspace and Facebook. Stealing music is also an illegal act that could get adults in alot of trouble. Sites such as Limewire and Bearshare are just some of the programs adults can go to. Adults can also use bad language and influence young children to do the same. Many adults are use tricks to socialize and popularize themselves with the younger generation of adolescent youth. These are just some of the problems we face with the adult population today.

Elementary Aged Students

The Ages
Elementary kids are all into instant messaging, IM lingo,and second nature. They're the ones who've come of age with MySpace.com, Facebook and social-networking sites. YouTube would be a much lonelier place without them. A lot of parents haven't progressed much beyond games and e-mail.So what's a grown-up to do when the younger generation seems almost fated by nature to be one step ahead? Does anybody have a handle on the possibilities of what little Jack and Jakie are doing online and how to deal with their activity?

Middle/ High School Aged Students

Middle Schools students with too much free time spent surfing the internet affects a family and a community. For example, let's take the case of thirteen year old Alisha. She lied about her age on a public page in order to have sexual intimacy. Legally, this is reported as a rape, but Alisha lied about her age, provoking this to happen. So now, Alisha is mentally affected and her life will never be the same. Her family's profit may decrease because of the money used in court. Now the family does not have very much money and sustaining themselves is a struggle. This family affects the community because now they are not paying taxes, or contributing to the economy. So because of a simple digital law being broken, an entire population is affected in a negative way.
A community may be affected in a very little positive way, although for some it can also be negative. If a student in a class sends all his classmates the newest movie both positive and negative events occur. It is positive because now the movie is very popular. A lot of people know it, and it could even win awards. All the students would be able to watch it and this would enrich their minds for free. It also has a negative impact in the sense that the authors or actors from the movie are not getting the money they deserve because their movie is being illegally distributed. This means that their salary decreases not allowing them to live better after all the work and hours dedicated to this movie.
A community is affected in a bigger way if a movie or software is illegally distributed. So the negative impact is greater; this means that there must be a stop to the illegal leaks.

Adults

Adults are some of the main people who tend to harass people, mostly youth. This is very unethical and serious. The victims of this henious crime may be mentally affected and have to take counciling for the rest of their lives if they are lucky. Some unfortunate cases have resulted in death. In many other cases, the victim or vicims have been sexually harrassed or raped. There is almost no positive effect on the communities, except for the fact that it is a good way to show younger generations what will happen if they are not educated in inernet safety.

4. Possible solutions to the problems that have emerged.



Elementary Aged Students

For the most part, parents could be a big solution to elementary aged student’s privacy on the internet. They could read the private policy statements on the website. This would keep children from giving out their personal information if they don’t want to. Another thing would be to make a decision if you want to give your child consent to use the computer service. You could check out the website first and make sure it’s something that you wouldn’t mind your child to be on.

Some solutions to digital problems with elementary aged students are as simple as blocking websites. A type of software that you can use is called McAfee Privacy Services. Educating the students in internet safety will inform them about dangers lurking in cyberspace.

Middle/ High School Aged Students

One solution to this ever expanding problem would be to get the students interested in something else. The people who are addicted to Myspace and Facebook often have nothing else to do. Think about it, when Johnny gets home from school instead of dumping his bag on the floor and staring at a flashing screen until 10:00 at night he has music lessons or basketball training. That is why sports of after school activites are crucial. If schools have more extra curricular activites then their students are doing productive things. If Middle School students don't go online that much and chat with adults, then the number of crimes will decrease. Eventually Digital Law will be abided. So as you can see, by just the simple solution of students spending time on other activites, adults and small children won't use the internet that much. This all solves major issues that come from too much free time on the internet. The difference is amazing.

Adults

Breaking the law:

On the internet you will come upon websites that will be breaking the law and you can report this to "NETALERT" www.neralert.vic.a, they will contact the authorities and put a stop to the website.


Another problem is copyright. There is an easy solution to this problem though, and this solution is creative commonscreative commons is a site that lets you easily make your own copyright laws for your work. There are rules like no one can make money off of your work, no one can change the appearence of your work, and many more. By making it a law that people have to use creative commons to put anything on the internet, you can reduce the amount of copyright laws broken.

Making adults aware of the consequences of their actions should help the problem dramatically. Most adults break digital laws thinking, " Oh yeah, sure, I'm not going to get into any trouble." when in fact they are on the verge to getting very serious legal punishment.

Laws that mainly refer to middle or high school students would include copyright infringment (e.g. limewire; downloading music/videos with the permission of producer/artist) and age restrictions on certian websites (e.g. Myspace, saying that you are 21 when you are really 15). These laws are not very strongly inforced and often slip past high athorities. They cant take the blame though as to control the internet would be an impossible task doomed to fail.
